Stumbo takes precautionary steps on late 2008 laws

FRANKFORT – House Speaker Greg Stumbo is encouraging state lawmakers who sponsored laws enacted after midnight on April 15, 2008, to re-file them word-for-word as bills for this year’s legislative session.

“Recent court rulings have confirmed what I have said all along: That stopping the clock on the last day of a session is unconstitutional,” Stumbo said Thursday in a statement. “The approach I am recommending will ensure that the will of the legislature is upheld, and will avert the need for any further legal action.”

Stumbo, D-Prestonsburg, was referring to a circuit court ruling Wednesday that said the 2008 General Assembly was wrong when it “stopped the clock” to conduct more action after the constitutional deadline of midnight April 15.

Franklin Circuit Judge Phillip Shepherd also ruled that the state’s six-year road plan contained in House Bill 79 last year is invalid because lawmakers did not enact it within the constitutional time limit.

Stumbo said Thursday that he has contacted the sponsors of nine House bills and file House joint resolutions that were sent to Gov. Steve Beshear last April 16. He also said he will recommend the same for two Senate bills.

Stumbo’s request does not include HB 79.

“Since the General Assembly will almost certainly take a closer look at revising our road projects in light of declining revenues, there would be no point in passing this plan again in its current form,” he said.

Those bills that passed after midnight April 15 include House Bill 2, the latest of several far-reaching energy bills adopted by the legislature in recent years, and Senate Bill 58, which tightened the criminal penalties for those who severely injure or kill a dog or cat.

The other bills are HB 170, HB 201, HB 204, HB 369, HB 514, HB 608, HB 683. HB 704, SB 188, HJR 6, HJR 81, HJR 82, HJR 83 and HJR 130.
