Steve Nunn's Psychiatric Evaluation Correctly Halted By Circuit Judge -- All I Can Do Is Continue To *SIGH* At The Unbelievable Spectacle Of The Case!

Nunn evaluation halted
By Tom Loftus

LEXINGTON, Ky. — Fayette Circuit Judge Tom Clark Friday halted a psychiatric evaluation of former state Rep. Steve Nunn and ordered that he be returned to the Fayette County Detention Center.

Nunn, charged with murder and violating a protective order in the Sept. 11 shooting death of Amanda Ross in Lexington, was moved from the Fayette jail to the Kentucky Correctional Psychiatric Center in La Grange Tuesday after an agreed order that he undergo the evaluation.

But on Thursday Fayette Commonwealth’s Attorney Ray Larson asked that the evaluation be stopped for several reasons. Among them is that, until a grand jury indicts Nunn and the specific charge against him is known, “the evaluator clearly cannot determine if the defendant is criminally responsible.”

Clark said Friday morning that because there is no longer an agreement for the evaluation, it would be halted and Nunn would be returned to Fayette County.

Astrida Lemkins, Nunn’s attorney, said afterward that the evaluation should be allowed to proceed and that she may appeal Clark's ruling to the Court of Appeals.

She said Larson had agreed to the evaluation but filed a late objection because he didn't want to hand over material gathered in the investigation that is necessary for the evaluation.
