Northup and Harper launch ads, Fletcher to follow but releases funds.

The long awaited television ad from Anne Northup has been launched. Watch "the only Republican who can win" ad. Also launching another ad is Billy Harper. This time it's the "NO" ad. Ernie Fletcher is expected to run his second ad sometime this week. I'll update you on it. Meanwhile, Fletcher has sent his third mail-out.

In another matter, Fletcher has authorized the EMERGENCY expenditure of $16.4 million for the state police, corrections department and Department of Juvenile Justice. According to Fletcher, "The failure of the House of Representatives to act on legislation to fund these needs, in House Bill 262, created risks to public safety which are not acceptable to me."

Any thoughts on the ads? Any thoughts on the emergency funding?

In 2005 the Supreme Court of Kentucky held in Fletcher v Commonwealth, 163 S.W3d 852, that the Governor has no constitutional authority to exercise legislative powers and order the appropriations necessary to prevent the imminent collapse of governmental services when the General Assembly has failed to do so. In addition the Supreme Court held that the Governor possesses no emergency or inherent powers to appropriate money from the state treasury that the General Assembly, for whatever reason, has not appropriated, overruling Miller v. Quertermous, 304 Ky. 733, 202 S.W.2d 389.

The court interpreted Section 230 of Kentucky's constitution and stated:

" The unambiguous language of constitutional prohibition against withdrawing money from the State Treasury, except in pursuance of appropriations made by law, bars the withdrawal of funds from the state treasury in the absence of a specific appropriation, or a statutory, constitutional, or federal mandate."
