Obama asserts presidential powers he once spoke critically of

WASHINGTON — President Barack Obama is starting to channel his inner Cheney.

For years, Obama talked about the limits on presidential power. Now, driven either by principle or political expediency, he’s working to build and maintain a powerful presidency that pushes the edge of what it can do, while often telling Congress and the courts to mind their own business.

In the last week alone, he refused a subpoena to share Justice Department emails with Congress, told courts he doesn’t have to justify his claimed power to assassinate suspected terrorists and decided to stop deporting certain illegal immigrants even though Congress has refused to enact a law to do that.

Those moves cap a slow buildup of executive branch power since Obama took office in January 2009. Some actions build on war powers seized by the administration of President George W. Bush and Vice President Dick Cheney. Some assert new domestic authority.

Taken together, they reinforce the strengthening presidential power that Cheney pursued ever since he served as White House chief of staff to Gerald Ford and watched Congress take power away from a presidency weakened by Vietnam and Watergate.

“Particularly with regard to national security powers, Obama is as vigorous in exercising those powers, and expanding some of them, as his predecessor,” said Gene Healy, the author of the book “The Cult of the Presidency: America’s Dangerous Devotion to Executive Power.”

At the White House, Press Secretary Jay Carney spoke Thursday of separation of powers rather than checks and balances, casting the decision to shield the Justice Department as part of the broader principle of presidential authority.

“It is his responsibility as steward of the executive branch to retain the capacity of this administration and every administration going forward to function appropriately and independently from the congressional branch of government,” Carney said.

“The assertion of privilege has to do with the absolute necessity of retaining the executive branch’s independence enshrined in the Constitution in the separation of powers to allow it to appropriately and independently . . . deliberate and respond to these kinds of inquiries.”

Obama started out more skeptical.

As a candidate in 2007, for example, he criticized Bush for using executive privilege to shield aide Karl Rove from congressional questions about politics in the Justice Department.

“There’s been a tendency on the part of this administration to try to hide behind executive privilege every time there’s something a little shaky that’s taking place,” he said then. “There doesn’t seem to be any national security issues involved. . . . I think the American people deserve to know what was going on there.”

This week, Obama asserted executive privilege to shield the Justice Department from a subpoena for emails, part of a congressional investigation into a possible political cover-up in the wake of the Fast and Furious gun scandal.

Last year, he rejected pressure to stop deporting the children of illegal immigrants, noting that Congress hadn’t yet approved the proposed DREAM Act, which would allow him to do that.

“Sometimes when I talk to immigration advocates, they wish I could just bypass Congress and change the law myself,” he said in Texas in May 2011. “But that’s not how a democracy works. What we really need to do is to keep up the fight to pass genuine, comprehensive reform. That is the ultimate solution to this problem.”

Last week, his administration announced that it would use prosecutorial discretion to stop the deportations of those young, illegal immigrants.

This week, his administration argued in a late-night court filing that it shouldn’t be required to reveal anything about its policy of targeting suspected terrorists abroad for death by drones, even if they’re U.S. citizens.

“We continue to have profound concerns with the power the administration is claiming and with the proposition that the president should be permitted to exercise this power without oversight by the courts,” said Jameel Jaffer, the deputy legal director of the American Civil Liberties Union.

“That the administration believes a power so sweeping should be exercised in secret is astounding.”

While Obama’s moves in the last week drew news media attention, others have been less noticed.

Earlier this year, he said he’d allow 10 states to stop obeying an unpopular education law as long as they agreed to new stipulations. The waivers from the No Child Left Behind act came as Congress has been unable to agree to a new national education law.

“It’s not simply that a waiver is granted, but that it comes with strings attached,” Healy said. “The administration as a condition of lifting some of the strictures will require certain actions that were never written into federal law. . . . The executive branch is essentially rewriting law with elements that never passed the legislature.”

The president also decided to stop defending the legality of another law, the Defense of Marriage Act, passed by Congress and signed into law by President Bill Clinton to stop gay marriage from spreading across state lines.

If Obama is asserting power for the executive branch, the legislative branch Thursday remained divided about what if anything it could or should do.

“That’s what presidents do,” said Rep. Elijah Cummings of Maryland, the ranking Democrat on the House Oversight and Government Reform Committee. “Trying to defend DOMA, that’s certainly within the discretion of the president and the attorney general. Immigration, that’s one where nobody was doing anything. Everybody agreed something needed to be done but nobody was doing anything. So I think it was appropriate for the president to step up.”

Sen. Lindsey Graham, R-S.C., sees a trend. “I think the narrative is building that they’re using executive power in a way that is uncomfortable to a lot of people,” he said.

In addition to the other recent examples, he noted Obama’s use of “recess” appointments to get nominees into the executive branch when the Senate objects but is arguably not in session. But Graham said it was up to the people, not Congress, to change that.

“The ultimate corrective tool in a democracy is not the opposite party as much as it is the people,” he said. “If they think you’re getting out of bounds, they’ll whack you. We’ve been whacked. He’s going to get whacked.”

Barney Frank On Acorn: He Calls For An Investigation -- Of The Investigators. HYPOCRITE, I Tell Ya!

In a letter published nearby, Representative Barney Frank takes us to task for an editorial last week in which we noted his absence from the House's 345-75 vote to defund Acorn, the "community organizing" group that has been caught on video at least five times offering advice on how to evade the authorities while enslaving children as prostitutes. Mr. Frank, whose spokesman tells us he would have voted against the measure (that is, in favor of funding Acorn), has a point. Any implication that he is trying to dodge the matter is mistaken.

Even after the recent revelations, Mr. Frank is a vigorous and unashamed defender of Acorn. Yesterday he and House Judiciary Chairman John Conyers sent a letter to the Congressional Research Service (CRS) requesting a "careful and objective analysis of a number of issues concerning ACORN." (Mr. Conyers voted to defund Acorn but later said he did so "accidentally.")

The investigation that Messrs. Frank and Conyers envision does not, to say the least, sound aggressive. They ask the researchers to get to the bottom of, among other things, "the extent to which ACORN has assisted [the] homeless." With respect to the child-prostitution sting, they ask the CRS to look into "conflicting allegations" about "the propriety of these activities"—by which they mean not the advice Acorn gave on getting away with crimes, but "the federal and state laws that could apply to such videotaping and distribution of conversations without the consent of all parties."

The Democratic duo also ask CRS whether the legislation defunding Acorn "could constitute an unlawful bill of attainder" by singling out the group—as if the refusal to continue providing federal subsidies is tantamount to punishing it for a crime. Such Constitutional scruples were not evident in March, when the pair joined all but six House Democrats (and 85 Republicans) in voting to impose a 90% tax on executives of AIG and other disfavored corporations.

Messrs. Frank and Conyers do ask if Acorn has misused federal funds or engaged in voter fraud—but the CRS is hardly in a position to investigate whether Acorn has committed such crimes. If Messrs. Frank and Conyers were serious about learning the truth, they'd send their letter to the Justice Department, not the Congressional Research Service.

Republican Party Of Kentucky Takes The Governor To Task For "Misusing The People's House", But Former Governor Ernie Fletcher Did The Same Thing.

GOVERNOR BESHEAR’S ETHICS HONEYMOON COMES TO AN END

Rents out ‘people’s house’ for political fundraiser

FRANKFORT, Ky. – The Republican Party of Kentucky Chairman Steve Robertson today blasted Governor Steve Beshear for his decision to “rent out” the Governor’s Mansion for a political fundraiser. Over the weekend, the Kentucky Democratic Party sent out invitations for a political fundraiser to be held at the Governor’s Mansion on June 24th.

“Less than one month after issuing a water-downed executive order on ethics reform, it is apparent Governor Beshear’s ethics honeymoon has come to an end,” Robertson said during an afternoon press conference in front of the Governor’s Mansion. “Clearly, the good old days of misusing the ‘people’s house’ are back. This kind of renting out of the mansion for partisan, political gain has not been seen in Frankfort since the days of Patton – one of the most unethical Governors in Kentucky’s history.”

Robertson referenced Governor Beshear’s inaugural address, noting how Beshear promised “a Kentucky where citizens trust that their leaders are doing the people’s business, not their own.”

Robertson also noted how ethics reform failed during the recent legislative session after Governor Beshear and House Democratic Leaders balked at the Republican-led State Senate’s more stringent version – which would have prohibited lobbyists and state contractors from giving to gubernatorial candidates and others running for statewide office.

“Using the Governor’s Mansion for political fundraisers does not represent the kind of ethical and moral leadership the people of Kentucky deserve,” added Robertson. “Governor Beshear has said that his administration should be held accountable and that it starts at the top with him. I call on Governor Beshear to make real ethics reform part of the special session call.”

Robertson also called on the Democratic elected officials listed on the invite, specifically Auditor Crit Luallen and Attorney General Jack Conway, to join him in disavowing this activity.

Kentucky Democrat Party Chair Jennifer Moore’s defended Beshear’s decision saying that Robertson was just “hurt that he is no longer invited to the mansion” and this was “simply an event for supporters of the governor at his private residence.”

“It is unbelievable that Jennifer Moore would make the insinuation that Republican’s are not welcome in the Governor’s Mansion,” concluded Robertson. “I would hope Steve Beshear and Jennifer Moore would have more respect for the ‘people’s house’ – than to use it as a member’s only, political clubhouse.”

But as the archives of the Lexington Herald - Leader shows, Governor Ernie Fletcher used the mansion to entertain highway contractors in a SHAMEFUL manner to solicit campaign contributions:

Naturally, then, Gov. Ernie Fletcher — forced to restart his re-election fund-raising from scratch after Lt. Gov. Steve Pence dropped off the ticket — has begun courting the contractors.

The governor invited more than a dozen paving company executives to the Governor’s Mansion last Wednesday for lunch, a policy presentation and a political chat in the mansion’s second-floor residence.

During the luncheon, Transportation Cabinet Secretary Bill Nighbert detailed how the state will shell out a record $2.3 billion in road funds to contractors over the next two years, said Robbie Rudolph, Fletcher’s executive secretary of the Cabinet.

The group later retreated to the residence to discuss the re-election campaign.

Wednesday’s event, which was partially organized by Amy Wickliffe — lobbyist for the Kentucky Association of Highway Contractors and former chief of staff to first lady Glenna Fletcher — instead was the first of several group meetings Fletcher hopes to have this summer, Rudolph said.

Nearly 40 percent of the $372,225 that Fletcher’s 2007 campaign raised in the last two weeks came from Kentuckians Fletcher placed on boards and commissions, highway contractors that depend on state money and government workers — mostly high-ranking political appointees — whom Fletcher hired. Road building company employees and their family members gave Fletcher at least $54,000 over the last 15 days.

Many contractor executives attended a luncheon at the governor’s mansion two weeks ago, during which Transportation Cabinet Secretary Bill Nighbert outlined how the administration gets to dole out $2.3 billion worth of paving work in the next two years.

More than $44,000 came from board and commission appointees or their family members.

He also hosted "God Talk," a Sunday morning program on religion, and was a prolific fundraiser for the station's charity drives.

The Kentucky Republican Party recently took at stab at Steve Beshear by releasing the following statement:

BESHEAR CAMPAIGN MAKES $95,000 PAYMENT TO COMPANY CONNECTED TO WIDESPREAD VOTER FRAUD

FRANKFORT, Ky. – Republican Party of Kentucky Chairman Steve Robertson today called upon various Kentucky law enforcement agencies to investigate payments made by Democrat Steve Beshear’s gubernatorial campaign to an out-of-state company with ties to widespread voter fraud. The announcement comes on the heels of recent criminal convictions in the Bath County vote buying scandal.
Beshear’s campaign finance report reveals that Urban Projects, Inc. received two payments, totaling nearly $95,000, for "field consulting" (Kentucky Registry of Election Finance Report, "Steven L. Beshear Itemized Disbursements," 5/6/07-10/10/07).
Additional records indicate that Urban Projects, Inc. is, in fact, a Philadelphia based company owned by Blair Talmadge and operating out of a building owned by his brother, Alexander Talmadge, Jr. (Pennsylvania Dept. of State, "Business Entity Filing History," 10/13/07).
In the mid-1990’s, Alexander Talmadge, Jr. and the Philadelphia "Democrat Machine Team" were involved in one of the worst voter fraud scandals in the history of Pennsylvania politics. While a City Commissioner and member of the Philadelphia Board of Elections, Alexander Talmadge, Jr. was found to have used his office to engage in a fraudulent scheme to illegally manipulate absentee ballots to assist the Democrat candidate. Blair Talmadge worked for his brother in the Commissioner’s Office.
The race was contested in Federal court, and a United States District Court Judge concluded that the election fraud committed by Alexander Talmadge, Jr. and the Philadelphia "Democrat Machine Team" was so widespread and egregious that the Judge overturned the election (Marks v. Stinson, 1994, WL 146113).

"Steve Beshear is fraternizing with a company associated with individuals that have no problem instigating widespread voter fraud," stated Robertson. "Beshear’s substantial payments to the Talmadge enterprise raise serious red flags about what Urban Projects, Inc. was actually hired to do here in Kentucky."
Testimony in the Philadelphia case revealed that Commissioner Talmadge used his office to secretly deliver boxes of absentee voter applications and ballots to Democrat operatives who would then improperly influence voters to fill out their ballots for the Democratic candidate. Some of these Democrat campaigners even filled out the ballots themselves and forged the signatures of voters who were not legally registered to vote (Marks v. Stinson, 1994, WL 146113; Philadelphia Inquirer, "Talmadge’s Role in 1993 Voting Scandal Shadows Him in Bid for City D.A.’s Office," 4/24/01).
Even more shocking, the Judge found that the "Democrat Machine Team" paid $1.00 per ballot bounty to operatives who could secure absentee votes for the Democrat candidate. These fraudulent votes effectively bought the election (Marks v. Stinson, 1994, WL 146113).
"To ensure the integrity of this election, I have alerted various law enforcement agencies to the sensitivity of this matter and called upon them to investigate the payments immediately," continued Robertson. "However, I hope that Steve Beshear will take action today and provide voters with an explanation as to why he would associate with a company connected to voter fraud."
"With the situation in Bath County on the forefront of our minds, Kentucky voters need to be assured that this election is not being bought by any candidate – and that the illegal tactics of the Philadelphia ‘Democrat Machine Team’ will not be tolerated here in the Commonwealth," concluded Robertson.

But what the news release fails to state is that it appears that the same Urban Projects, Inc., has been a significant contributor to Republicans.

So it is OK when Republicans accept campaign contributions from Urban Projects, Inc., but apparently ALL is NOT WELL when Beshear's campaign pays money to Urban Projects, Inc. .

AMAZING, isn't it?

The sheer hypocrisy is stifling, just as the hypocrisy surrounding the non issue of a gay couple giving campaign contributions to Beshear campaign is also EQUALLY stifling.

I guess Republicans hope that the mere mention of the word "gay" will get a repulsive knee jerk reaction from Conservative Christians like me, but it is OK when they have Republican GAYS in their "log cabin", including those like Senator Larry "toilet guy" Craig, who goes "toe tapping" with a "wide stance".

Keller continued, "Steve Beshear’s recent finance report shows two things; one, that it sure takes a lot of money to hide a liberal record from Kentuckians, and two, that Steve Beshear and his cronies obviously believe that the marriage amendment was a farce.
"Beshear signed his name to a document, under the penalty of perjury, swearing that he believed the contents of the report were accurate. When he signed that document, he violated the Kentucky Constitution’s definition of marriage in the Commonwealth," concluded Keller.

Obama "calls out" Clinton, admits he doesn't have the "wrong kind of experience". I say good for you, Obama;, and, then me and Michelle Obama.

President Clinton says that Obama doesn't have the experience to be President. Continuing, Bill Clinton said: "The same old experience is not relevant. ... And you can have the right kind of experience and the wrong kind of experience,"

By so speaking, Bill Clinton, as is peculiar to him, and to politicians like him, he CONVENIENTLY forgot his own opinion on experience, which he self-righteously expressed when he ran against Bush, sr., and Ross Perot for President:


Reacting to the OBVIOUS hypocrisy (surprise, surprise), Obama responded in kind today by saying: "[Clinton's] exactly right,... [W]hat we need to do is put an end to the wrong kind of experience", and "the nation does not need the kind of experience that tinkers around the edges instead of doing something fundamental about how lobbyists operate in Washington."

Then continuing: "We need the kind of experience that I think I bring to this race, of bringing people together to get things done." Read it here.

I say good for you, Obama. My sentiments, EXACTLY.

On another related matter, after I posted this about Michelle Obama, I received an email from her that made me say, Oh, oh -- it was captioned "Re: Hey" and I thought she was going to give me an ear full. It turned out it was a form letter seeking my contribution.

It made me laugh out LOUD after I read it. Then I figured that, since his campaign STILL hadn't refunded my money from the sold out Lexington event, she can use that money and QUIT asking me for more.

And then I laughed out LOUD some more.
